Dayton Township Zoning Board
Public Hearing November 19, 2007,
Doug Graham, the Zoning Board Chairman, called the Hearing to order at 7:30 Pm. Present were Doug Graham, Chris Yens, Richard Overton, Earnest Coleman, and Nancy Chin.
Doug Graham, the Zoning Board Chair, welcomed the public and explained the agenda for the hearing, as well as the rules for speaking at a public hearing. He then requested that the Secretary of the Zoning Board read the letter, received from Mr. and Mrs. Mock regarding the first order of business: the Special Land Use application. Once the letter was read, Doug Graham then asked Mr. Shawn Hughes to explain the purpose of his request for a Special Land Use Permit. Mr. Hughes explained that he would like the permit to be able to use part of his property as a campground.
Doug Graham then opened the hearing up to the Public for questions and comments.
Mr. Bernard Bishop, residing at 3710 Hurds Corner then read a three page letter with all of his concerns regarding the campground,(Letter available for viewing upon request).
Mr. Rick Seidler, who did not state his address, spoke regarding the issues involved, when placing a campground next to land zoned as agricultural conservation; spraying of insecticides, large animal, crops, flies and whether or not Mr. Hughes would be willing to put up a performance bond on the property.
Mr. RJ Gilmore, residing at 3610 Hurds Corner, spoke regarding his concerns regarding the campground; fires, size of camp sites, maintenance of the said property, questioning the upkeep of property in its present state concerning the burnt out pole barn on the property, insurance to cover the liability.
John from Freemont Township, did not state his full name or address, spoke about the campground at Crystal Lake on Washburn Road, stating that they had to put a fence around the campground and a detailed plan to scale must be included for the State permits.
Doug Graham, then stated that the campground must occupy 20 acres and a detailed drawing that is to scale with a detailed site plan must be included before the Zoning Board can proceed further in order to be able to answer all the Publics concerns on this matter. Another Public Hearing will be set for December 13, 2007 to further address this matter.
Second order of business: Doug Graham introduced Mr. Derrick Fells request for an amendment to current Zoning to change his property and the other adjoining parcels west of his property and south of Shay Lake Road from Wetland Conservation to R-2 medium density residential so that he may build a retirement home. He explained that he purchased the property for this reason in 1991 before it was rezoned as Wetland Conservation.
Mr. Joe Peet, 4300 Turner Rd., introduced himself and then requested that the Zoning Board grant Mr. Fells request.
Mr. Rick Seidler, stated that the DEQ determined that this particular land was wetland due to soil samples.
Doug Graham explained that the DEQ had already consulted on this issue and gave Mr. Fells the permission to request from the local Zoning Board to rezone the area, due to no known wetland plants growing on the stated property that would determine it as wetlands through the State. Richard Overton made a motion to change the Wetland Conservation zoning on this property to R-2 medium density residential, Earnest Coleman seconded the motion, Chris Yens-yes, Doug Graham-yes, and Nancy Chin-yes, so passed the motion. Mr. Fell’s property #005-012-000-0890-01 and adjoining parcels west of his and south of Shay Lake Rd. will now be rezoned as R-2 medium density residential.
Doug Graham introduced the third order of business for the evening, which was the Frank Franzel property. This property is presently zoned as R-3 high density residential, a permit was incorrectly written for an agricultural pole barn by the previous Zoning Administrator. To bring the building into compliance the land needs to be rezoned to Agricultural Conservation.
At this point, the topic was opened to the Public for comments or questions.
Rick Seidler questioned whether Mr. Bill Robinson’s property also needed to be rezoned due to a permit he had mistakenly written in an unknown previous year. Doug Graham stated that the issue being discussed this evening was concerning the Franzel property and requested all remain focused on the current issue at hand. Doug Graham opened up the discussion once again for any further questions or comments of which there were neither. A Motion was made by Chris Yens to approve the change on the Franzel property from its current zoning as R-3 high density residential to Agricultural Conservation. Motion was seconded by Earnest Coleman, Richard Overton-yes, Doug Graham-yes, and Nancy Chin-yes and so passed the motion. The property of Mr. Franzel’s # 79-005-031-000-1250-00 is now rezoned as Agricultural Conservation.
