DAYTON TOWNSHIP
Proposed Regular Meeting Minutes
January 7, 2008

Meeting was called to order at 7:30p.m. with the pledge to the flag. Members Bob Cook, Stacy Phillips, Eleanor Kilmer, Bob Steele and Mike Mocniak were present.

The corrected minutes from December 3, 2007 were motioned for approval by Steele and seconded by Mocniak. Motion carried minutes were approved and available on the web page at www.daytontwptuscola.org.

AMBULANCE REPORT: Glenn Fox reported the meeting was on the 11th of December at 7:00p.m. and the minutes and financial reports were approved. There are no changes as far as the volunteer staff, but if anyone is interested there are first responder classes starting in Vassar soon. Any interested persons can call Jim Welke for details. They had a reported run count of 291 for the year and were lucky recipients of the Arlene Western estate, so they are possibly looking into the purchase of a new ambulance. They would still keep the old one as a stand by.

ZONING BOARD: Doug Graham commented on the public hearing that was held on the 13th of December in regards to the campground/special land use permit for Shawn Hughes. The zoning board approved his permit with conditions as follows:
1. A 4’ woven fence must enclose the property containing the campground.
2. A Michigan firm must draw up the detailed site plan within 6 months.
3. The campground must be staffed 24 hours a day and 7 days a week during the open season.
4. All permits must be pulled at all levels (Federal, State, County, and Local).
5. A detailed site map must be supplied.
Doug also stated that the Zoning Board members had numerous questions for Shawn Hughes concerning this matter, and it will take Mr. Hughes a lot of work to get the approvals at the other levels. The Zoning Board/Planning Commission will meet again on the 21st of January, which is misprinted on the meeting schedule, and at this time they will organize and elect officers in order to be in compliance with a Planning Commission.

ZONING ADMINISTRATOR: Bob Cook reported that he had a slow month with only 1 permit for a pole barn for Greg Daily.

CEMETERY: No report and no burials for the month.

PUBLIC COMMENT: Bernie Bishop was present to voice his concerns and comments in regards to the campground. If everything is performed as stated then he did not have any problems, but if the conditions were not met as stated from the Zoning Board then he would not approve. He, also had concerns about the noise level, lights and the location of the campground and what would happen if they were not located as stated, would the Zoning Administrator and Zoning Board take care of these matters. He did have those questions about the noise levels and or other disturbances, and if the police had the ability to take care of these problems.

SUPERVISOR: Bob and Dale have to go to Lansing to the State Tax Commission on the 17th of January to go over the review that the Township recently went through. He is not sure what will happen, but they might make the Township hire an appraiser to make everything up to date.

TREASURERS REPORT: There is an income of $21,895.14 mostly due to revenue sharing of $21,595.00 and expenses of $15,471.43 due to garbage, wages and such. Totals in checking $4,368.61, money market $118,426.31 and balance on hand $426,888.77
Taxes are coming in and there is one extra day due to February 29th.

CLERKS REPORT: There are invoices check #5201 - #5233 in the amount of $17,986.42 to be paid, which are mostly due to garbage, tax processing and wages. Steele motioned to pay these said invoices and Mocniak seconded. Motion carried the bills will be paid.
Stacy also mentioned about looking into using a new accountant. She will bring back a fee and possible contract, to compare with Kings, from Gary Anderson at next months meeting. Eleanor mentioned that the Township used Gary Anderson in the past and she did not have any problems with him.
The election is on the 15th of January and all voters must have a photo ID or they will have to sign an affidavit instead. This must be done in order to vote. The polls open at 7:00 a.m. and all vote at the hall located at 4879 Hurds Corner Rd., Mayville.

UNFINISHED BUSINESS: Bob Cook gave a brief overview from the transcript and letters he had from the public hearing the Tuscola County Road Commission had for Byington Road, and he stated that the Township could not afford the cost to repair the road or the attorney fees that it would take. The road would have to be hard surfaced to be certified, which now it is considered a non-certified road, and with the turnaround the cost would be around $32,000 plus. If this road was pursued to be abandon it would take a petition signed by 7 residents or free-holders sent to the Tuscola County Road Commission, which at that time it would up to them to decide ultimately what they (TCRC) wanted to do. Cook stated that spending any more money on this project is not something that the Township should do. With numerous questions and comments made from the board and floor it was motioned by Mocniak and seconded by Steele that we leave Byington Road status as is and do nothing more with this project. Motion carried.

NEW BUSINESS: Shawn Hughes property was the order of business at this time, and with an overview of what the Zoning Board had recommended with the conditions, the board and floor had many comments and questions. Steele wanted to make sure that if the Township Board approved the Special Land Use permit that Mr. Hughes still had to satisfy the conditions before he could receive the permit to go ahead with the campground. It was stated that the Zoning Administrator and Zoning Board would follow through with the project and all the conditions have to be met. Graham stated that it is not a little project, by any means, there are numerous permits and rules that have to be followed from the Federal, State and County levels before it gets to the Local boards. With all stated Steele motioned that we follow the Zoning Boards recommendations and Mocniak seconded. Motion carried Shawn Hughes can go ahead with the special land use permit, for the campground, as the Zoning Board recommended with the conditions (that are stated previously in these said minutes).

Meeting was then motioned for adjournment at 9:20 p.m.
