Section 4. – Penalties and Enforcement
A. Notification. The owner, if possible, and the occupant of any property upon which any of the causes of blight or blighting factors set forth in Section 3 is found to exist shall be notified in writing to remove or eliminate such causes of blight or blighting factors from such property within ten (10) days after service of the notice upon them. Such notice may be served personally or by the United States Post Office. Additional time may be granted by the enforcement officer where bonafide efforts to remove or eliminate such causes of blight of blighting factors are in progress.

B. First violation of this Ordinance shall be a civil infraction punishable by a fine not to exceed One Hundred ($100.00) Dollars. A citation for civil infraction may be issued by the enforcement officer as designated by the Dayton Township Board of Trustees. Each day that a violation exists shall constitute a separate offense.

C. Subsequent violations of this Ordinance shall be a misdemeanor punishable upon conviction by fine not to exceed One Hundred ($100.00) Dollars or by imprisonment in the county jail for a period not to exceed ninety (90) days or by both such fine and imprisonment. A misdemeanor violation may be initiated by a citation issued by the enforcement officer as designated by the Dayton Township Board of Trustees. Each day that a violation exists shall constitute a separate offense. In addition to the foregoing penalties, anyone convicted of violating this Ordinance under this provision shall be assessed the costs of prosecution including any attorneys fees incurred by the Township.

D. This Ordinance shall be enforced by such person or persons as may be designated by the Dayton Township Board of Trustees.

E. In addition to the foregoing penalties, the Dayton Township Board of Trustees may initiate an action in the Tuscola County Circuit Court seeking an injunction or declaratory judgment granting the Township authority to remove all causes of blight as identified and assess the costs of said action against the owners of the property where such blight is located. Costs shall include costs of initiating said action, including any attorneys fees incurred by the Township.
