Approved Regular Meeting Minutes
April 6, 2009
Meeting was called to order at 7:30 p.m. with the pledge to the flag. Members Bob Cook, Stacy Phillips, Eleanor Kilmer, Bob Cook, and Mike Mocniak were all present. Minutes from the March 2, 2009 regular meeting were motioned for approval by Mocniak and seconded by Steele. Motions carried minutes are approved. Minutes from the March 28th budget public hearing were motioned for approval by Steele and seconded by Mocniak. Motions carried minutes are approved.

Public Comment: James Satchel commented to the residents and board in regards to a petition that he presented to the board, requesting that Landmark Appraisal be available to explain to the residents how they came up with their figures when reappraising the Township parcels, and the board present any and all deposit and income statements, expenses incurred through the Township. Stacy presented James with all deposit and income statements along with the budgets from 2005 until present after the March 28th meeting.
Many residents then had some comments in regards to the reappraisal and how Landmark came up with their figures. Bob proceeded to explain how the process works from the time a permit is issued, when it goes to the county and through the assessor, and then applied to the parcel/landowners cards. These cards were not kept up to date so when the Township was audited by the State, the State required that the Township get these cards up to date within a certain amount of time, hence is why the company Landmark Appraisal was hired.
At this time there were residents that had a” Thank You” to pass along to the board for jobs well done through the Board of Reviews handling of this situation, and for a road that was repaired in a timely manner.
Randy Somerfield had a concerned for a permit that he was issued, that since has expired and, the zoning ordinance has changed also, which has affected his ability to move his trailer onto his property. Bob suggested that he take this to the Zoning Board of Appeals for a zoning variance.

County Commissioner: Tom Kern was present to give the board and residents a report. He started by explaining a Hazard Mitigation Plan through FEMA to help clean up any hazard waste incidents that should occur. He suggested that the Township should adopt this resolution in case of any emergency of this sort, and with this resolution there will be funding available through FEMA if it is needed.
They Board of Commissioners are also looking to hire a new Mosquito Abatement Director for the 2009 season.

Planning Commission: The next meeting is April 20th at 7:30 pm, and at this time there is nothing scheduled for the agenda. They are still working on the blight ordinance along with the blight committee.

Zoning Administrator: Bob commented on the addition for the hall and thanked everyone for their hard work and good job of getting this project done. He also invited anyone that was interested to look at the addition after the meeting.

Cemetery: There were no burials for the month, but Nancy Fritz has been in contact with Eleanor again in regards to the Township purchasing the 2 acres. The board commented that we are waiting on this and still looking into other options.

Blight Committee: They are still working on the ordinance, and Rick Seidler had mentioned that the Township board possibly looks into giving Linda Davis some type of compensation for all her work.

Tuscola County Planning Commission: Ione Vyse, whom is the vice chair of this board, was present to give the Township board their new book, the Tuscola County General Development Plan, she also informed the board the our represent from the TCPC is Joe Robbins. Ione then explained the new guidelines for turning information into the TCPC and how it should appear when presented to them.

Board of Review Report: Richard Horsch, whom is the chair of the Townships Board of Review, commented on the meetings that they had and how many residents turned up to have their petitions heard. He thanked people for having patients and understanding during this long process. He also stated that they did not find many disagreements with the agricultural properties, but they did not agree with all the figures applied to the residential properties (through Landmark Appraisal). The figures that they used was then explained and Richard wanted residents to know that the board had to go by state standards, but they did lower those they could through the township, with in the limits of the law. Richard commented that if any resident was dissatisfied that they are encouraged to appeal to the State Tax Tribunal.

Treasurer: Eleanor recapped the annual report that she had presented the board on March 28th (which are in those minutes). She then commented that she had received one (1) zoning permit for $20, and $150 for land divisions, and two (2) fire bill payments for $750 and $950.
If any more taxes are turned in they now go to the county for payment where the resident also will have to pay the penalty for being late.

Clerk: There are invoices to be paid check #5594 - #5626 in the amount of $102,430.84, which some of these are from the fiscal year end of 2009, Steele motioned to pay these said invoices, seconded by Mocniak. Motion carried bills will be paid.
Stacy then had read the thank you letter from the Opperman Library along with a letter from them in regards to their open house scheduled for April 18th from 10:00 am to 3:00 pm.
A letter from Mayville Area Ambulance Service was then read, which was a recap of the information that is provided by Glenn Fox, when he gives his reports.

New Business: The resolution to adopt the Tuscola County Hazard Mitigation Plan was motioned by Mocniak, and seconded by Steele. Motion carried with a roll call voted to follow: Steele – Yes, Mocniak – Yes, Kilmer – Yes, Phillips – Yes, Cook – Yes. The resolution will read as follows: Whereas Dayton Township, Michigan is vulnerable to a wide range of natural, technological and human- related hazards, and has experienced repetitive disasters that have caused loss of life, damaged commercial, residential and public properties, displaced citizens and businesses, closed streets and presented general public health and safety concerns; and

Whereas Tuscola County has prepared a Tuscola County Hazard Mitigation Plan that provides an understanding of those threats, identifies the hazards affecting the area, discusses the county’s vulnerability to the identified hazards, and outlines the community’s options and strategies to reduce overall damage and impact from natural and technological hazards; and

Whereas the Tuscola County Hazard Mitigation Plan represents the interests and needs of Dayton Township;

Now therefore, be it resolved that:

The Tuscola County Hazard Mitigation Plan is hereby adopted as an official plan of Dayton Township.

Meeting was then motioned for adjournment at 9:20 pm.
